Sa imbestigasyon nga gipahigayon sa kapulisan, nahibaw-an nga pasado 4:00 sa kaadlawon samtang nahinanok ang duha nisulod ang tulisan sa luyong bahin nga pultahan sa health center armado og kal.45 nga rebolber. Mailhan nga hubog ang gikatahapan ug walay gisul-ob nga tsinelas.

Gisukit-sukit pa ang mga biktima kon duna ba daw pasyente. Wala makuntento ang tulisan diriyot panamastamasi si Radin apan tungod sa kahadlok nalooy lang usab kini. Gibana-bana nga nagtambay og duha ka oras ang maong tulisan ug gihapit og tulis ang health center dayon biya.

Pag-abot niya sa highway sa Camp Downes, ni-overtake siya sa nag-una ka niyang Toyota Hi-lux van. Apan duna sad nagsingabot nga mini-bus nga gimaneho ni Edgar Eloisa, 50-anyos nga nagpuyo sa Southern Leyte.

Kusog usab ang dagan sa ka-engkwentrong mini-bus nga gikan sa lungsod sa Baybay kay nag-apas sa oras. Nagkabangga ang duha ka sakyanan ug nilagpot ang motorsiklo lakip na si Lison ug sa dihang nitugpa na gibawian sa iyang kinabuhi gumikan sa kaguba sa iyang ulo nga wala na gyud hapit mahitsura tungod sa kakusog sa impact.

Nianang pasado 5:00 sa hapon, usa ka field inspector ang gikawatan samtang naglakaw sa dalan. Ang nireklamo sa kapulisan mao si Edwin Tumampo, 31-anyos, nagpuyo sa Punta, ning syudad. Matud sa iyang reklamo nga nagbaktas siya sa dalan Mabini, Dist. 4 pasado 5:00 sa hapon padulong sakayan og tricycle. Wala siya kaalingat nga gihinay-hinay na diay og siklot ang iyang dalang DVD player ug duha ka cellphone nga Nokia 3510 ug 3600.

Sa laing bahin, usa ka call center agent ang gikawatan og pouch samtang naglukat og tiket sa barko niadtong Enero 15. Ang nagpaabot sa iyang problema sa Presinto 1 ua ka Leah Lacandasa, 32-anyos, dalaga ug lumad nga taga-lungsod sa Dulag. Base sa iyang saysay nga naglukat siya og tiket sa dalan Rizal pasado 7:00 sa gabi-i ug samtang naglingkod siya gihinay-hinay diay og siklot ang iyang itom nga pouch nga dunay sulod nga P640 nga kuwarta ug mga ATM cards sa UCPB, ug Metrobank.

Police gun down 2 Motortrade robbers

IT was a productive week for the men of Precinct 1. Not only did they capture one of the masterminds in the Motortrade robbery, two of the suspects were killed when they tried to fight their police escort. But all these wouldn’t have happened if not for the information given by an anonymous tipster.
 

Killed by the police were Ruel Publico alias “Gagang,” 25 and Anderson Perez, 26. On the other hand, the police are holding in their custody Ruel Manidlangan, one of the two masterminds. The three are accused of robbing the Motortrade store in Cogon last Dec. 31 of P45,421.
 

A lead on their identities fell on the lap of Precinct 1 OIC Insp. Alvin Shevert Machete through an anonymous letter sent by Publico’s neighbor last Jan. 4. The letter specifically named the perpetrators and how they fled after robbing Motortrade by crossing the Anilao River to Cantalib.
 

A sketch map was attached to the letter pointing to Publico’s house at Purok Tondo, Bagong Buhay, this city. The tipster said he had always been suspicious about the suspects who seemed to be awash with cash despite being unemployed. He didn’t bare his identity for fear of his family’s safety.
 

Insp. Machete immediately acted on the tip which led to the arrests of Publico and Perez in Sto. Niño that afternoon. They were positively identified at Precinct 1 by Motortrade manager Rail Agner and credit collector Edwin Monares. During interrogation, the two identified their masterminds as Manidlangan and another one whose identity the police wouldn’t bare.
 

At 8:55 that night, the policemen brought the two to Dongol where one of the masterminds supposedly resides. They rode on a convoy of two vehicles. The first vehicle carried the suspects while Insp. Machete rode the second one. When they reached a sugarcane field however, Publico tried to grab SPO3 Tomas Serrano’s 9mm service firearm.
 

They struggled until the three fell off the open-type police vehicle. SPO3 Serrano was jumped from behind but he freed himself by elbowing Perez and giving him a head butt. Publico got the pistol and was about to shoot SPO3 Serrano but he was shot first by the cops in the second vehicle.
 

The suspects were rushed to Ormoc District Hospital but they were declared dead on arrival at past 9:00 pm. Taken from Publico and Perez during their arrest were two backpacks, each containing a loaded cal.38 revolver and hand grenade exactly as the letter sender wrote. One of them also had a 2” knife.
 

On Jan. 6, the police conducted an operation to arrest Manidlangan. He was nabbed noontime near his home in Danao. He was also armed with a cal.38 revolver for which he is charged for illegal possession of firearm. Insp. Machete said they found other evidences that would link them to the robbery at Cogon Family Bakeshop last Dec. 21.

Tax Code defended from critics

COUNCILOR Ruben Capahi, chairman of the committee on ways and means admits that not all the provisions contained in the proposed 2011 Comprehensive Tax Code will be implemented this year. The City Council deferred passage of the Code to incorporate the suggestions they gathered from the public hearing, he said.

This development already disputes critics’ accusation that the administration is bent on passing the measure by hook or by crook and that the public hearing was only a moro-moro (for a show). On the contrary, it is the noisy critics who refuse to listen to the Council’s reasoning, Capahi adds.
 

One explanation is the fact that many of the rates charged by the local government unit (LGU) were last adjusted in 1992, ’97 and 2000, and need to be updated. An example is the P5 certification fee which is being raised to P20 when other LGUs are charging P50 for the same.
 

Citing also the same certification fee, Capahi said the proposed adjustment is 300% which critics are bloating when in fact the increase is negligible from P5 to P20. One participant at the public hearing insists that the LGU subsidize the rates as a form of social service.
 

Other increases like the 426.3% business tax to be imposed on fastfoods and restaurants from P190-P1,000 are one-time payments annually. Capahi points out that these increases are still miniscule compared to those charged by neighboring towns of Ormoc.
 

Capahi also defends the proposed water rate increase, saying the prevailing P3.50/m3 is not enough to maintain the chlorination and pumping process as well as the operations in general of Ormoc Waterworks and Sewerage Administration. Moreover, the proposed P7/m3 rate is still lower than the P15 and P17/m3 charged by Merida and Albuera towns, respectively.
 

Capahi is also dismayed that provisions of the Code that benefit taxpayers are not trumpeted like the 5% prompt payment discount and reduction of the amusement tax from 30% to 10%. Despite the deferment, there was no word of appreciation from those who demonized the Council as insensitive.
 

Even if the Code has been thoroughly scrutinized for more than a year, Capahi said they are willing to study it further because even members of their committee have their own suggestions. He did not specify however what provisions will be implemented this year and the next.

'Payong-payong' is back at the food park

THE infamous payong-payong at the food park is back, this time with a wholesome image. Last Jan. 8,the  Ormoc Food Park Vendors Consumer Cooperative (OFPVENCCO) held a blessing for the “reopening” of the payong-payong area, named as such due to the umbrellas festooned at the tables.

The area was vacated last May because of the huge outstanding balances of beer vendors from their daily rent. The moniker payong-payong also earned a notorious reputation as a red light district. But the place has shed off this unsavory image with the takeover by OFPVENCCO of its operation.

OFPVENCCO Consultant Edwin Codilla said a set of guidelines in the tenants’ contract will assure that the place will maintain its wholesome atmosphere. Under the guidelines, ladies’ drinks and obscene behavior are prohibited. A 2:00 am curfew will also be observed. OFPVENCCO President Pacita T. Martinez assures they can police their own ranks.

The payong-payong also has a new look with 18 stalls that allow vendors to sell foodstuff like burgers, pizza, sizzling steaks, etc. (except barbecue). Asia Brewery Inc. donated tables and umbrellas to the stalls. Each stall is allowed only four tables but exceptions on this rule and on the curfew will be made during special occasions like the fiesta, Tugob festival and holidays.

Each stall is charged P25 a day whether it opens for business or not of which P20 is remitted to the local government unit (LGU) and the P5 goes to OFPVENCCO. The LGU and OFPVENCCO are expected to earn at least P129,600 and P32,400 respectively annually.

Editorial: Ormoc needs the Tax Code

THE decision by the City Council last week to defer the passage of the proposed 2011 Comprehensive Revenue Code should not be misconstrued as an admission of fault by its members. On the contrary, the move is a manifestation of our councilors’ sensitivity to the people’s pulse.

It’s a given that any increase in taxes is an unpopular move, but that doesn’t make the Revenue Code anathema to public interest as what its critics succeeded in painting, no thanks to the publicity they generated in cooperation with media outlets identified with the opposition.
 

Though not perfect, the Revenue Code is a thoroughly studied and well-crafted piece of legislation. Still, it is open for improvements that were sought at the public hearing. While the procedure managed to solicit helpful inputs, some participants succeeded in drowning the Code’s well-meaning intentions by twisting facts to make it unpalatable to public opinion.
 

What was supposed to be a tool that would help keep Ormoc in its growth path has been politicized by personalities whose motives are highly dubious (they’re the same characters who contributed to discrediting the administration in the last election). And they just happen to be the noisiest at the public hearing which they ironically denounced as undemocratic.
 

Now that the Code’s implementation is deferred, you won’t hear them give credit to the Council for yielding to their wish. What is seen from them is an overbearing smugness for beating the Council to submission. The consultation process has been reduced into a propaganda war which they won – or so they thought.
 

Their plot to sabotage the Code is apparent by their unreasonable demands and shallow arguments like when they insisted that tax breaks provided by all Philippine laws be put in the Code even if it would be impossible to keep track of tax exemptions in all Republic Acts, Executive Orders and memorandum circulars of every government agency. This will also entail constant amendment of the Code whenever a tax exemption is repealed or newly enforced .
 

A position paper submitted by private sector leaders hinted that the policy environment in Ormoc is not conducive for business and economic activities, reason why many investors have bypassed the city in favor of Baybay. Now why does that sound familiar? Oh, it’s a rehashed election issue against the administration.
 

But let’s indulge them on their argument. By investors, they must be referring to the two oil mills and pulp plant in Baybay. Of course those industries will bypass Ormoc because copra and abaca are in abundance in Baybay. Whereas it’s sugarcane for Ormoc, reason why we have the country’s first bio-fuel plant here. But they didn’t they mention that.
 

We are constantly bombarded by the disinformation that Ormoc is not business-friendly, as if there is a synchronized effort to direct the people’s mindset to that direction, maybe to provide Richard Gomez an excuse for failing to fulfill his electoral promise of bringing big-ticket investments to Ormoc like Teletech.
 

It is every Ormocanon’s wish to see their place improve and keep up with bigger cities. What we don’t consider is the fact that residents pay bigger taxes in big cities. Now that Ormoc is growing at an unprecedented pace, the LGU needs more resources to respond to the expanding needs and new challenges brought about by progress.
 

Otherwise, it will be us Ormocanons who will bear the brunt of inadequate social services, aging infrastructure, public fiscal deficit and a breakdown in peace and order. It’s as simple as that. No need to wrack our brains on unreasonable demands and shallow arguments.

Why the Church is against family planning

WHY is the Catholic Church so adamantly opposed to any scientific method that ensures proper birth control? Why has the Catholic Church stubbornly maintained its ridiculous position against family planning during the last 64 years? Why has the Catholic Church been so opposed to birth control in spite of all the available scientific data clearly showing the dangerous consequences of large families on the physical, mental and spiritual health of parents and children?
 

The more logical question is, why does the Catholic Church provide all the irrational, unhealthy, unscientific, ignominious and ridiculous excuses to support their vague and baseless arguments against any family planning based on scientific methods of contraception?
 

The answer lies on the Pope’s stand on papal infallibility (ultramontanism).
 

Stephen D. Munford, PHD, president of the Center for Research on Population and Security, Chapel Hill, North Carolina wrote in his article “Why the Church Can’t Change:
 

“Hans Kung, the renowned Swiss Catholic theologian, best summed up the problem of Catholic Church accounting against contraception when he said, ‘It is not possible to solve the problem of contraception until we solve the problem of infallibility.’”
 

In his book, “How the Pope Became Infallible,” Catholic historian Bernhard Hasler describes in great detail what Küng meant: Hasler wrote: “For more than a millennium, the Vatican had possessed temporal power which ensured its survival. With the loss of the Papal States in 1870, it appeared all but certain that a strong Papacy would simply disappear. The Vatican urgently needed a new source of power. Papacy needed a group of conservative and influential leaders including Pope Pius IX (1846-1878) who came up with a brilliant idea for a new source: ‘an infallible pope.’”
 

What is infallibility of the pope? According to Catholic dogma, the pope is God’s representative on earth and God guides him as he cares for His flock. When the pope formulates a doctrine, he is simply transmitting this dogma on God’s behalf. Therefore, the teaching cannot be in error. Thus, the pope’s teachings are absolute, final and infallible. Such an arrangement placed enormous control and power in the hands of the pope. (To be continued next issue)

Let me share this

AS we prepare to face this New Year, we always promise ourselves improvements, if not change, for the better. I’m sharing with you some of the articles I find useful in this world where we have to cope with a lot of toxic elements that are not of our own making but we are compelled to deal with. This would be my gift to the loyal followers of my column in this paper. This article, “Harnessing good stress,” is from MSNBC:

“Stress is not always a bad thing — it’s what you do with it that’s key. Here are some ways to avoid the pitfalls of pressure overload:
 

· Think of the glass as half full. We can’t make stress go away but we can change how our brains react to it. An optimistic look at life can give more of a feeling of personal control and help limit the elevation of stress hormones.
 

· Focus on the task at hand. An unexpected deadline at work or home can give a burst of hormone-related energy, but don’t feel you have to do everything at once. If you feel overwhelmed, say no to taking on more tasks.
 

· Fight the urge to be a superman or wonder woman. You’re not perfect, so don’t expect it from others. Prioritize and be realistic about work deadlines. Don’t hesitate to ask for help.
 

· Exercise. Regular, moderate exercise helps make your body more resistant to the negative effects of psychological stress.
 

· Meditate. Try to think of pleasant moments or nothing at all. Just 10-20 minutes of quiet time can relax you and increase your tolerance to chronic stress.
 

· Be alert to stress clues. Frequent colds, cold sores, backaches, headaches, difficulty thinking clearly, irritability or insomnia are signals that your body and immune system are suffering from too much stress.”
 

To those who, like me, have so many things to do and so little time to do it, sleep is a luxury. This reminder to myself may be useful to others, too.
 

Six reasons you need a good night’s rest:
 

1. It maintains a strong immune system. Sleep deprivation compromises immune function and makes you more vulnerable to disease.
 

2. It slows aging. Too little sleep elevates levels of stress hormones and lowers levels of growth hormone necessary for cell repair. In one study, young, healthy sleep-deprived subjects had the hormonal profiles of much older people.
 

3. It prevents diabetes. Sleeplessness increases insulin resistance, a precursor to type 2 diabetes.
 

4. It keeps you slim. When you’re sleep deprived, you have more of the appetite-stimulating hormone ghrelin in your blood and less appetite-curbing leptin, a combo that leaves you longing for junk food.
 

5. It helps maintain a sharp memory. Even one sleepless night impairs concentration and memory and can affect job performance.
 

6. It can make you happier. Insomniacs face a higher risk of depression, alcoholism and suicide.
May we be able to sleep better on 2011.

Medina inaugurates new Isabel terminal

MAYOR Jun Medina led the inauguration of the new land transport integrated terminal last Jan. 8 in Isabel town. The terminal sits on a 1.4-hectare land at the highway in Sto. Niño, less than a kilometer from the poblacion. Contractor Rex E. Morales took 12 months to finish the project.

The terminal was built at a cost of P34 million through a 15-year loan obtained from Development Bank of the Phils. at 4.8-7% (variable) interest depending on market rates. It accommodates all forms public utility vehicles (PUV) in Isabel like buses, multicabs and tricycles.
 

The terminal is complete with amenities like an administration building, passengers’ lounge, two comfort room buildings and 42 commercial stalls that have all been reserved. Terminal Supervisor Manuel M. Enmil Jr. identifies some of the tenants as a travel and tours office, three Internet shops, four feedstock stores, six eateries, two meat shops, computer store, lotto outlet, computer repair shop, etc.
 

Mayor Medina hopes the terminal, being the show window of their “humble but ambitious town,” will leave a lasting impression to tourists along with their decent lodging places. Waiting for PUVs is no longer stressful and irritating, while law enforcers are present to secure the passengers’ safety, he said.
 

Mayor Medina is hopeful the commercial component of the terminal will trigger new economic activities that would result to more employment opportunities. He also hopes tourist buses will make Isabel their endpoint of inter-island travel so that drivers will spend their days off in Isabel.

Acetylene Gang still in jail despite bailable case

THE lawyer of the Igorot Acetylene Gang, Atty. Julius Calumnag, arrived from Mt. Province to post bail on its members who were caught breaking into Cebu Gold Pawnshop last Christmas. All eight suspects are charged of frustrated robbery which is bailable at P24,000 for each suspect.

But the suspects remain in jail as the police wants to make sure there are no other cases filed against them in other places. So far, Precinct 1 received only one feedback from the National Bureau of Investigation. Suspect Elvis Lawig has a pending case of theft at RTC Branch 6 in Baguio.
 

He also has four criminal records namely two cases of illegal possession of deadly weapon in Mt. Province filed in July 12 and 16, 1982 and he was sentenced for robbery with violence and intimidation in Feb. 11, 1991. It is not yet clear if he has already made time for these offenses.

City gov't told to defer tax code implementation

A GROUP of private sector individuals is requesting the local government unit (LGU) to defer the implementation of the 2011 Revenue Code of Ormoc. They are asking that more time and consultations be given to enable the public to scrutinize the proposed measure.

In a three-page letter addressed to Councilor Ruben Capahi, chairman of the ways and means committee, the civic leaders expressed concern on the varying levels of tax increases to be imposed on businesses. “It is very difficult to determine the rational basis for such impositions and we could not understand the pattern,” they said in the letter.

The increases range from 6.4% to 900% depending on the nature of business. One of the biggest tax increase, for example, will be imposed on fastfoods and restaurants at P1,000 from P190 or a whooping 426.3% hike. KTV/cocktail bars and similar establishments will pay 344.4% more on business tax or P1,000 from the present P225 (see table below).

But the most contentious increase that will affect the general public is water rates. Ormoc charges the lowest water rate in the country at P3.50/m³ for the first 10m³ and P3.85/m³ above 10m^3. The Revenue Code will raise this by 185% to P10/m³ for the first 41-50m³ and P11/m³ above 50 m³.

The Code will also begin to tax newly operated businesses at 7.5% of 1% of capital investment. It will also impose P20 monthly garbage fee on residents which will reflect on the water bill. The civic leaders believe these will make Ormoc unattractive to investors.

The letter criticized the hasty public hearing on the Revenue Code last Dec. 22 and 23 which it describes as “untimely” with many businessmen busy with year-end activities failing to attend. The general sentiment at the consultation is that the public wasn’t given enough time to study the Code as the 120-page document was distributed only during the first week of December.

The sectoral leaders urges the LGU to gather more inputs from multi-stakeholders and conduct more forums at the barangay level. In view of this, they also request ample time to allow various interest groups to study the proposal and come up with intelligent and realistic recommendations.

Otherwise, the LGU may not effectively enforce the Revenue Code for lack of acceptability from the general public, they warn. “People may end up disobeying…for the simple reason they are unable to comply with the ordinance,” the letter reads. The measure is now on second reading at the City Council.

The signatories of the letter are Engr. Jovencio Laurete Jr., president of Ormoc Chamber of Commerce and Industry; Ma. Milagros L. Rizarri, president of IAL Corp.,; Atty. Roy Bernard Fiel, vice president of Ormoc Sugar Planters Assoc.; Iñigo Larrazabal, incoming president of Rotary Club of Ormoc Bay; Atty. Benjamin Pongos, president of Ormoc Memorial Gardens; Marissa Omoto, president of Philippine Institute of Certified Public Accountants-Ormoc chapter; and Benedicto Lambunao, president of Ormoc Motorized Tricycle Operators and Drivers Association.

Motorcycle store robbed

ANOTHER establishment was robbed this time on New Year’s Eve. Two masked robbers entered Motortrade in F. Ablen St. near the corner of Lilia Ave. 1:00 pm and divested the motorcycle store of P45,421 in cash and the cellphone units of three employees.

Branch secretary Melody Esmero, 22, single of Punta, this city said the suspects, wearing ski masks, t-shirts and short pants, didn’t take long to do the job. Armed with a gun, the robbers ordered the employees to surrender the money and cellphones then casually walked out the store.

Also in the store was manager Ramil Agner, 36 of San Miguel, Leyte and credit collector Erwin Monares, 29 of Hibulangan, Villaba town. Precinct 1 OIC Insp. Alvin Shevert Machete is dismayed by the employees’ delayed distress call and the absence of a CCTV camera in the store.

Had the employees called immediately, the police led by City Police Dir. SSupt. Nilo D. Donayre would have responded earlier and caught the robbers considering the suspects didn’t had a getaway vehicle and just walked towards the direction of Isla Verde, Insp. Machete said.

Responding policemen conducted a hot pursuit operation but failed to catch the robbers. Instead, they nabbed a junkie by the name of Randel Rapales, 27, single of Mabini St., this city. He was caught at Purok Dama de Noche in Cogon in possession of three small sachets of shabu, two rolled marijuana leaves, a Nokia 5310 cellphone and P3,793 in cash. He was sent to the Philippine National Police crime laboratory in Palo town and was charged of violating RA 9165 or the Dangerous Drugs Act. By Dong Arañez

Police crack down on illegal firecracker manufacture, sale

AS part of the implementation of Oplan Paputok, the Ormoc Police Office swooped down a house suspected of illegally manufacturing pyrotechnics last Dec. 31. Subject of the inspection is the residence of Gerry Andrew Macias at Doña Feliza Mejia Subdivision, this city.

The inspection was made considering there are only two licensed pyrotechnics manufacturer in Ormoc who happen to be both Muslims. Macias complained about the absence of a search warrant upon the arrival of the police and denied manufacturing firecrackers, saying whatever pyrotechnics the police found in his house were for personal consumption.

City Police Dir. SSupt. Nilo Donayre explained that even without a warrant, they are duty bound to conduct the inspection to ensure the safety of the community. His men failed to find a large quantity of pyrotechnics and believe the owner hid them. But without a warrant, they couldn’t search the house.

Eventually, Macias admitted to selling pyrotechnics and even showed a business permit for the purpose. At the vacant lot across his house, police found traces of gunpowder which led them to suspect even more that firecrackers are being manufactured at that place.

That same day, three firecracker vendors were arrested at the public market. Elements of Precinct 1 led by PO1 Ariel Pia Nuñez conducted a saturation drive 11:00 that morning and chanced upon the three vendors. The sale of pyrotechnics is only allowed at the plaza seawall.

Ormoc mulled as venue for One Visayas confab

THE provincial government of Leyte is planning to host this year the One Visayas convention of the Regional Development Councils of Western Central and Eastern Visayas. Because of the absence of large venues in Tacloban and Palo, Gov. Carlos Jericho L. Petilla said the activity may be held in other cities in the region like Ormoc, Leyte or Maasin, Southern Leyte.

Participants who gather to the annual One Visayas come from local governments, line agencies, state colleges and universities, and private sector groups of Regions 6, 7 and 8. Previous One Visayas activities were Cebu held at Cebu International Convention Center and Gerry Roxas Foundation Convention Center in Roxas City.

“We really would like to have One Visayas held here in 2011 and we’ll just look for a good venue for that,” said Gov. Petilla, the new chairman of the Regional Development Council (RDC) in Eastern Visayas. The activity is seen to promote the business, tourism and economic potentials of Leyte and Region 8.

RDC-8 already hosted one activity of One Visayas in 2010 dubbed as Visayas Health at Leyte Park Hotel in Tacloban. The RDC 8, played host to the affair in partnership with the Department of Health (DOH)-Center for Health Development under Regional Dir. Edgardo Gonzaga. Other One Visayas activities are the Climate Change Summit as well as Culture and Arts Festival that were held in Cebu and Roxas Cities.

One Visayas is the brainchild of and is led by the chairpersons of the RDCs of each of the three regions: Antique Gov. Sally Perez, Cebu Gov. Gwendolyn Garcia and Samar Rep. Mel Senen Sarmiento for Region 8 who formerly chaired RDC-8. (PMRC)
